In discussing whether legal systems are necessarily coercive, legal philosophers usually appeal to thought experiments involving angels or other morally driven beings who need no coercion to organise their social lives. Such appeals have invited criticism. Critics have not only challenged the relevance of such thought experiments to our understanding of legal systems; they have also argued that, contrary to the intuitions of most legal philosophers, the ‘man on the Clapham Omnibus’ would not hold that there is law in a (...) society of angels because the view that law is necessarily coercive ‘enjoys widespread support among laypersons’. This is obviously an empirical claim. Critics, however, never systematically polled the ‘man on the Clapham Omnibus’. We boarded that bus. Higher courts sometimes assess the constitutionality of law by working through a concrete case, other times by reasoning about the underlying question in a more abstract way. Prior research has found that the degree of concreteness or abstraction with which an issue is formulated can influence people's prescriptive views: For instance, people often endorse punishment for concrete misdeeds that they would oppose if the circumstances were described abstractly. We sought to understand whether the so-called ‘abstract/concrete paradox’ also jeopardizes the consistency (...) of judicial reasoning. In a series of experiments, both lay and professional judges sometimes reached opposite conclusions when reasoning about concrete cases versus the underlying issues formulated in abstract terms. This effect emerged whether participants reasoned with broad principles, such as human dignity, or narrow rules, and was largest among individuals high in trait empathy. Finally, to understand whether people reflectively endorse the discrepancy between abstract and concrete resolutions, we examined their reactions when evaluating both, either simultaneously or sequentially. These approaches revealed no single pattern across lay and expert populations, or exploratory and confirmatory studies. Taken together, our studies suggest that empathic concern plays a greater role in guiding the judicial resolution of concrete cases than in illuminating judges' professed standards—which may result in concrete decisions in violation of their own abstract principles. Despite pervasive variation in the content of laws, legal theorists and anthropologists have argued that laws share certain abstract features and even speculated that law may be a human universal. In the present report, we evaluate this thesis through an experiment administered in 11 different countries. Are there cross‐cultural principles of law? In a between‐subjects design, participants (N = 3,054) were asked whether there could be laws that violate certain procedural principles (e.g., laws applied retrospectively or unintelligible laws), and also (...) whether there are any such laws. Confirming our preregistered prediction, people reported that such laws cannot exist, but also (paradoxically) that there are such laws. These results document cross‐culturally and –linguistically robust beliefs about the concept of law which defy people's grasp of how legal systems function in practice. (shrink)

Prescriptive rules guide human behavior across various domains of community life, including law, morality, and etiquette. What, specifically, are rules in the eyes of their subjects, i.e., those who are expected to abide by them? Over the last sixty years, theorists in the philosophy of law have offered a useful framework with which to consider this question. Some, following H. L. A. Hart, argue that a rule’s text at least sometimes suffices to determine whether the rule itself covers a case. (...) Others, in the spirit of Lon Fuller, believe that there is no way to understand a rule without invoking its purpose — the benevolent ends which it is meant to advance. In this paper we ask whether people associate rules with their textual formulation or their underlying purpose. We find that both text and purpose guide people’s reasoning about the scope of a rule. Overall, a rule’s text more strongly contributed to rule infraction decisions than did its purpose. The balance of these considerations, however, varied across experimental conditions: In conditions favoring a spontaneous judgment, rule interpretation was affected by moral purposes, whereas analytic conditions resulted in a greater adherence to textual interpretations. In sum, our findings suggest that the philosophical debate between textualism and purposivism partly reflects two broader approaches to normative reasoning that vary within and across individuals. Our goal was to explore self‐care practices among men who have sex with men in the context of Mpox in Brazil. This study used qualitative research methods, including interviews and thematic analysis, to collect and analyze data from male participants across the Brazilian territory. The narratives unveil men's perspectives on self‐care, risk reduction, and health beliefs during the Mpox pandemic. Our findings highlight a multifaceted approach to self‐care among men, encompassing hygiene, physical contact management, mask usage, skin lesion vigilance, and (...) adherence to official guidelines. Men's attitudes toward sexual behaviors emphasize the importance of reducing sexual partners, practicing safe sex, and combating misinformation through accurate information dissemination. The development of these behaviors and self‐care practices can be facilitated by nurses guided by Dorothea Orem's Self‐Care Theory, supported by patient‐centered care, with strategies to address and confront the stigma associated with the disease and provide emotional support. Thus, the study underscores the pivotal role of self‐care in mitigating infection risks, especially in the context of emerging infectious diseases. It acknowledges the impact of socio‐cultural factors and healthcare policies on men's preventive measures. However, it also recognizes limitations, such as potential bias due to stigma concerns and a nonrepresentative sample. Ultimately, the research advocates for tailored education, promotion of gender equity, and healthcare empowerment to effectively manage health risks in such contexts. (shrink)

I propose and defend a proof-based account of legal exceptions. The basic thought is that the characteristic behaviour of exceptions is to be explained in terms of the distinction, relative to some given decision-type C in some decision-making context, between two classes of relevant facts: those that may, and those that may not, remain uncertain if a token decision C is to count as correctly made. The former is the class of exceptions. A fact F is an exception relative to (...) some decision-type C, I claim, if (i) the ascertainment of F is sufficient for a token decision C not to count as correctly made, and (ii) the ascertainment of the negation of F is not necessary for a token decision C to count as correctly made. I also recuperate, reconstruct and discuss some of HLA Hart’s early views on defeasible judicial decisions. These two projects are closely connected: the latter is a vehicle for the former. (shrink)

Resumo: O presente texto apresenta o Núcleo de Estudos de Filosofias e Infâncias com seus vinte anos de ensino, pesquisa e extensão dedicados ao ensino de filosofia e uma educação filosófica. O texto tematiza a especificidade e a história do grupo, colocando ênfase em algumas dimensões de sua atuação presente: a) Os colóquios internacionais de filosofia e educação; b) a NEFI edições; c) o Mestrado Profissional em educação filosófica com infâncias; d) os projetos de extensão; e) o periódico childhood & (...) philosophy; f) as experiências de formação. Antes, um breve histórico é oferecido e, depois, uma reflexão sobre a dimensão metodológica do NEFI. Assim, o texto é oferecido como uma oportunidade para pensar o NEFI como um coletivo – possibilidade aberta e em permanente busca de sentidos relativos ao ensino de filosofia ou, para dizê-lo mais amplamente, a uma educação filosófica. One persistent question in jurisprudence relates to the role of morality in the concept of law. For instance, consider the question of whether unjust statutes are laws. Legal positivists say that they’re laws in every relevant sense, while natural lawyers say that they’re not. This article considers a different answer inspired by recent findings in experimental philosophy: there is one relevant sense in which unjust statutes are laws, but also a different relevant sense in which they aren’t. After considering the (...) ways in which this alternative differs from some of the mainstream theories in general jurisprudence, the article argues that it provides more elegant solutions to two problems that have puzzled legal philosophers in the past: the paradox of customary international law and the shifts in legal discourse over history. Separately, within cognitive science, there has been a growing body of research concerned with questions about how people ordinarily attribute purposes. Here, we argue that these two separate fields might be connected by experimental jurisprudence. Across four studies, we find evidence for the claim that people use the same criteria to attribute purposes to physical objects and to rules. In both cases, purpose attributions appear to (...) be governed not so much by original intention or by moral value as by current practice. We argue that these findings in the cognitive science of purpose attribution have implications for jurisprudential questions involving purposivist legal interpretation. (shrink)

O artigo busca refletir sobre as diferentes concepções de Família, tanto em sua constituição histórica quanto em sua formação cultural e social atual, com ênfase na garantia legal e institucional do “direito familiar” no Estado de Direito do Brasil. Analisa as transformações históricas da Família e destaca sua importância sociológica, psicológica e cultural, para a humanização e a formação da dignidade de cada pessoa. Trata-se de um estudo bibliográfico e histórico, com um resgate institucional e conceitual, seguido de uma interpretação (...) das interrelações entre Famílias e Escolas, postas para a promoção do sucesso escolar e cultural das crianças e dos adolescentes. Aponta a Educação como um importante campo de articulação entre as esferas familiares e a sociedade, acentuando a importância de estudos que vinculem a questão da Família como Direito Humano inalienável. The purpose of this article is to define and restore, in a systematic way, the decisive argumentative axes that allow a degree of internal consistency to the famous expressive interpretation of Spinoza’s philosophy made by Gilles Deleuze. Initially, we will examine how the Deleuzian interpretation of Spinoza portrays a peculiar and unique moment of the relations that Deleuze, during at least three decades, has established with the history of philosophy. Then, we will check which conceptual frameworks – built in a (...) non-hierarchical manner, according to Deleuze – would support the thesis of an intrinsic and practical necessity to the ontological constitutive process in Spinoza’s Ethics under the perspective of a philosophy of difference. O segundo, por sua vez, é fruto de uma conferência de abertura ministrada por Fritz Berolzheimer na ocasião do III Kongress der Internationalen Vereinigung für Rechts- und Wirtschaftsphilosophie, realizado entre os dias 02 e 05 de junho de 1914 na Akademie für Sozial- und Handelswissenschaften em Frankfurt am (...) Main. A abertura do congresso realizada por Berolzheimer, assim como outras conferências proferidas ao longo do mesmo, foi publicada em Stuttgart pela Franz Steiner Verlag no mês seguinte à realização do congresso, isto é, em julho de 1914 no volume 7, número 4, da ARWP. Translation of the initial chapters of Aristotle’s Prior Analytics into Portuguese and introduction, which addresses interpretative disagreements and translation choices.

As muitas verdades sobre a infância de nosso tempo, das mais catedráticas às mais “inovadoras”, encontram-se compiladas em livros e artigos dentro e fora de nossas bibliotecas. Grosso modo, elas constroem dois tipos de niilismo. Um niilismo de tipo universalista, que suga a criança para fora da imanência da vida e da histórica e a torna refém de estereótipos universais. Outro niilismo de tipo relativista, que esquece a criança e apenas acusa os estudos da infância como mera invenção. Evitar esses (...) extremos requer uma espécie de arte acrobática de equilibrar-se na possibilidade de um entre. Essa via busca retomar a imanência histórica da criança. Trata-se de uma pesquisa em busca da potencialização da ideia de invenção cuja atitude crítica implicasse não a pergunta pelo governo certo ou pela ausência de governo da infância, mas como não a governar assim, por essas pessoas, em nome destes princípios, em vista de tais objetivos e por meio de tais procedimentos.
